RULES FOR THE PROMOTION “WIN A MAGICAL WEEKEND”

1. IDENTITY OF THE ORGANISING COMPANY Draws organised by the company PROMOCION Y DESARROLLO DEL ALTO ARAGON S.A., with address at Calle Santo Ángel de la Guarda, 7, 22005 Huesca, with tax ID 22330369, hereafter PRODESA. 2. PURPOSE OF THE PROMOTION The tourist promotion of the Province of Huesca and all its counties. 3. TIMING AND CHARACTERISTICS OF THE PROMOTION The promotion consists of two free draws that will be carried out as indicated in point 5. The duration of the promotion will be the period between 15 June and 30 November 2008 (both inclusive), hereafter the PROMOTIONAL PERIOD. 4. REQUIREMENTS FOR PARTICIPATING THE PROMOTION People who are of legal age and who provide the organising company with the following personal details, via any of the media given in point number 5, may take part in the draw: Name and surnames, year of birth, sex, mobile phone number, e-mail address, postal address, postcode, town/city of normal residence, nationality. How do you usually travel? Alone, with partner, with a group of friends, as a family or for work reasons. Where do you prefer to stay? Hotel, small hotel, guest house, apartment, rural guest house, refuge, hostel, campsite, chalet, holiday centre, spa, aparthotel, parador, others. Which activities are you most interested in? Art and culture, nature, sports and adventure, festivals and traditions, theme parks, gastronomy, wine tourism, the road to Santiago, skiing/snowboarding, ornithological tourism, others. What means of transport do you use on holiday? Own car, hire care, bus, train, plane. Have you ever visited the Province of Huesca? Yes, No. What do you know about the Province of Huesca?____. Do you think you will ever visit it again? Yes, No. Would you recommend Huesca, based on what you know about it? Yes, No. Employees of PRODESA or anyone directly linked with the company may not take part in this promotion, nor may their direct families or the employees of companies directly or indirectly involved in making this draw. Anyone who has provided incomplete or erroneous details will be excluded from the promotion. 5. FORMS OF PARTICIPATION AND MECHANICS OF THE DRAW PRODESA will provide information about this promotion via its website: www.huescalamagia.es, where the data collection form with the specifications appearing in point 4 will appear. The ways to take part are: -Providing the details mentioned in section 4a via the form on the website. -Providing the details mentioned in section 4a via the form provided by PRODESA via authorised personnel in the course of visits to the Zaragoza International Exhibition (trade fair complex, metropolitan parks, surroundings) or in the course of the actions organised by PRODESA anywhere as a result of the National Geographic Exhibition or for any promotional purpose. The form can be returned, filled in, to the same person who handed it out or sent to PRODESA by post. Once a person has provided the details they will be considered a participant and they will come to form a part of the participants’ database belonging to PRODESA. These details will be computerised and, as they are incorporated into the database, each participant will be assigned a number with which they will participate in the draws. Once the promotional period is over, the participants’ database will be closed. The draws to determine the prize-winning participants from among all those making up the participants’ database will be carried out before the Notary Public on 19 September 2008, for the first draw, and on 12 December, for the second draw. The participants in the first draw may not take part in the second draw. In the first draw, 25 numbers will be extracted corresponding to the numbers automatically assigned to each participant when the details in the database are computerised up to the point when the first draw is carried out. In the second draw, 25 numbers will be extracted corresponding to participants numbered in the database after the first draw is carried out. The draw will be carried out before the Notary Public, extracting balls numbered between 0 and 9, indicating as each ball is drawn if it is for units, tens, hundreds, thousands, etc. 25 reserve numbers will also be extracted for each draw. These will be made available in order of extraction so that if the winning participants cannot be located within 10 natural days following the draw or if they do not accept the prize in writing, these reserves will be the winners. The location and notification to the winning participants will be carried out using the details provided on the form, with e-mail the first option. If, two natural days after the e-mail is sent, written confirmation from the prize-winner has not been received, either by e-mail or by post, a call will be made to the mobile phone indicated by the participant on the form. If the mobile phone is not answered after six rings and the prize-winner has voicemail, a message will be left in the mailbox indicating that they should contact PRODESA. If the participant does not do this within two days, the participant will be replaced by another from the waiting list. If the mobile phone does not have voicemail, two further calls will be made in addition to the initial one, one a day, making a total of three calls in three days, each with six rings. If after these calls the participant does not contact the company or if we have not been able to talk to him/her, the prize will be understood to have been rejected. In all cases, the prize must be accepted in writing, indicating the name, surnames, contact telephone number, e-mail address, postal address, postcode, town/city and province, sex, year of birth and mobile phone number. The period for acceptance by the prize-winner will be five natural days. PRODESA reserves the right to disqualify participants in the promotion who breach the terms and conditions of the draw or the booking conditions for the accommodation and restaurant(s). Prodesa has no obligation to notify the winner by any other means not specified in these rules. 6. PRIZES The prizes drawn are 50 weekend stays for two people in bed and breakfast accommodation existing in the province of Huesca, and dinner for two people with the financial limit indicated below, including: Bed and breakfast accommodation for two people. Arrival at the establishment will be on Friday night, which will be the first night stayed, and the second the following night, Saturday, leaving on Sunday. There will be two nights’ bed and breakfast accommodation in a double room. There will be two nights and two breakfasts per person, on the Saturday and Sunday. In addition there will be dinner for two people on Saturday night, with a maximum limit of €100 total maximum cost of the dinner. If, for any reason, the prize-winner and his/her companion prefer to enjoy these two nights’ bed and breakfast accommodation and a dinner for two people on days of the week that are not at the weekend, this is possible provided availability at the establishments so allows and Visitaragón can make the arrangements. The average value of the prize is €300 including VAT for each “magical weekend” with accommodation (two nights in a double room), breakfast (two breakfasts for two people) and a dinner (dinner one night for two people). By taking part in the draw, the winners accept and authorise that their names and those of their companions may be mentioned on the websites and in any other publicity organised by Prodesa for promotional or information purposes provided they are related to the draw, without any kind of financial remuneration. Prizes may not be exchanged or substituted. They are also in the winner’s name and may not be transferred to any other person who is not the winner. All costs in addition to that indicated in the average value, and that stipulated for the dinner, will be payable by the prize-winner or whoever generates them. If this occurs, Prodesa reserves the right to undertake legal action. 7. RECORD BEFORE A NOTARY PUBLIC AND PUBLICATION IN THE ABACO ARCHIVE The rules of this promotion have been recorded before the Notary Public and deposited with the Government of Aragón. These rules may be consulted in the ABACO archive of the website of the General Council of Notaries Public: www.notariado.org Prodesa reserves the right to amend the conditions of this draw at any time or even to cancel it for reasons outside Prodesa’s control or which may make this action advisable. The company pledges to publicise the new rules or final cancellation. 8. MANAGEMENT, BOOKINGS AND DATES The management and booking of the accommodation in the different establishments and restaurants making up the prize will be carried out by the Aragón-Visitaragón Booking Centre, for which Prodesa will pass on to it the details of the people who have won prizes, strictly for these purposes. Both the weekends and the other possible days chosen by the prize-winner will be indicated by Visitaragon. These dates and establishments will be indicated depending on the availability of the establishments, and will always be in the low season for the establishments. If it is possible to go on dates other than traditional weekends, this will be indicated to the prize-winners. 9. ACCEPTANCE OF THE RULES Merely by taking part in the promotion participants implicitly accept of each and every one of the conditions included in these rules, as well as conformity with the decisions made by Prodesa in applying them. 10. TAX POSITION The prizes involved in this promotion constitute income which is subject to and not exempt from Personal Income Tax in accordance with the provisions of article 7 of Act 35/2006, regulating Personal Income Tax. 11. DATA PROTECTION The participants’ personal data will be included in a file owned by Prodesa whose purpose is to facilitate the development of this promotional action and others Prodesa may carry out, so that information about the province of Huesca and its range of leisure, tourist and cultural activities can be sent. On providing their personal data, participants in the promotion consent to its use for the purpose indicated in the above paragraph. The data will not be passed on in any way. If services must be contracted from third parties (sending letters, for example), Prodesa will pass on the personal data that allows the provision of the corresponding service, complying at all times with the applicable personal data production regulations. The holders of the data may exercise the rights of access, correction and cancellation free of charge by writing to Prodesa, Santo Ángel de la Guarda, 7, 22005 Huesca. In accordance with applicable data protection regulations, Prodesa pledges to keep all personal data and adopt the measures necessary to prevent its alteration, loss, processing or unauthorised access, considering the state of the technology at all times. 12. JURISDICTION The courts of the city of Huesca will hear any litigation arising from the interpretation or application of these rules and the parties waive any rights they may have to any other jurisdiction.
